1. Acceptance of Terms

By creating an account or using CrateMate, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use CrateMate. Your continued use of the platform constitutes acceptance of these terms and any updates we may make to them.

2. Eligibility

To use CrateMate, you must:

• Be at least 18 years of age. By creating an account, you confirm that you are 18 years or older.
• Maintain only one account. Each person is permitted to have only one CrateMate account. Creating multiple accounts is prohibited and may result in termination of all accounts.
• Provide accurate information. You agree to provide truthful and accurate information when creating your account and using the platform.

CrateMate is available worldwide without geographic restrictions. However, you are responsible for ensuring that your use of the platform complies with the laws of your jurisdiction.

3. User Conduct

CrateMate is a community built on trust and mutual respect. The following activities are strictly prohibited:

• Fraudulent Listings: Misrepresenting the condition, authenticity, or existence of vinyl records. All listings must accurately describe the item being offered for trade.
• Harassment: Engaging in harassment, bullying, threats, or any form of abusive behavior toward other users.
• Spam & Commercial Solicitation: Sending unsolicited promotional messages, advertisements, or using CrateMate for commercial purposes outside of genuine vinyl trading.
• Fake Accounts: Creating accounts with false identities, impersonating others, or creating multiple accounts.

Violation of these rules may result in immediate account termination without prior notice.

4. Swaps & Transactions

CrateMate is a platform that facilitates connections between vinyl collectors. CrateMate does not participate in, monitor, or take responsibility for any swaps or transactions between users.

As a user, you are solely responsible for:

• Shipping Costs: All shipping costs associated with sending records are your responsibility. Users should agree on shipping arrangements before completing a swap.
• Condition of Items: Accurately representing and verifying the condition of records being traded. We recommend using the standard grading system and providing clear photos.
• Dispute Resolution: Resolving any disputes that may arise from swaps directly with the other party involved. CrateMate does not mediate disputes.

Use CrateMate at your own discretion. We recommend using tracked shipping and communicating clearly with your trading partners to ensure successful swaps.

5. Content & Licensing

When you upload content to CrateMate (including but not limited to profile photos, record images, and descriptions), you grant CrateMate a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute that content for the purpose of operating and promoting the platform.

You retain ownership of any content you upload, but you agree that:

• CrateMate may display your content to other users as part of the platform's functionality
• CrateMate may use your content in promotional materials
• CrateMate may remove any content at its sole discretion

You represent that you have all necessary rights to the content you upload and that your content does not infringe on any third-party rights.

6. Disclaimers & Liability

CrateMate is provided "as-is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

CrateMate is not liable for:

• Lost or Damaged Shipments: Any records lost, damaged, or stolen during shipping between users
• Fraudulent Activity: Any fraudulent behavior by users, including misrepresentation of items or failure to complete swaps
• Harassment: Any harassment or inappropriate behavior between users, though we will take action when reported
• Quality of Goods: The condition or quality of vinyl records received in swaps
• Service Interruptions: Any downtime, data loss, or service interruptions

7. Account Termination

CrateMate reserves the right to terminate or suspend your account at any time, without prior notice, for violations of these Terms of Service or for any other reason at our sole discretion.

Upon account termination:

• All ongoing swap requests will be automatically canceled
• You will lose access to your account and all associated data
• Your profile and listings will be removed from the platform

You may also delete your own account at any time through your Profile Settings. See our Privacy Policy for information about data retention after account deletion.

8. Intellectual Property

CrateMate and all associated branding, logos, designs, code, and content (excluding user-generated content) are the exclusive property of CrateMate and are protected by intellectual property laws.

You may not:

• Copy, modify, or distribute any part of the CrateMate platform
• Use automated tools to scrape, crawl, or extract data from CrateMate
• Reverse engineer or attempt to derive the source code of the platform
• Use the CrateMate name, logo, or branding without express written permission

9. Modifications to Service

CrateMate reserves the right to modify, suspend, or discontinue any part of the service at any time without prior notice.

This includes, but is not limited to:

• Adding, changing, or removing features
• Updating the user interface
• Modifying these Terms of Service
• Temporarily or permanently shutting down the platform

We will make reasonable efforts to notify users of significant changes, but you acknowledge that CrateMate may be modified or discontinued at any time without liability to you.

10. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these terms or your use of CrateMate shall be resolved exclusively in the courts of Estonia. By using CrateMate, you consent to the jurisdiction of these courts.
